Terms and ConditionsIn general, most digital products are licensed for personal use only. You are not able to share these files. Often times there are commercial use options available. With this option you are able to use the products to create small runs of unique products. Please note that we take piracy very seriously. Piracy is The unauthorized use or reproduction of copyrighted material. All of the designers at MyTagArt work very hard to create unique and innovative products for your use. And while there is substantial time devoted to their designs, they keep their pricing low and affordable so that digital scrapbooking and tagging never becomes out of reach of the general public. Please keep this in mind if the temptation arises to share items you've purchased with friends. Thanks!
Images & Tubes
1. Under no circumstance is the sharing of tubes, packages or any other product from MyTagArt allowed. If you have a license and are in need of replacements, MyTagArt will replace the items within 72 hours, 7 days a week, therefore there is never a reason to share a package, even with a license holder! Sharing of passwords and download links are strictly prohibited. This is a direct violation of the artist's copyright. Anyone found to be in violation will have all licenses revoked and will be prosecuted to the fullest extent of the law.
2. Your license will consist of TART and your initials. Use the first two letters of your first name and the first two letters of your last name, and include TART before or after your initials. Example: For the name Bob Jones, his license initials would be "TARTBOJO" or "BOJOTART". Unique License numbers are available upon request only. To request an unique license number please contact: admin@mytagart.com. Your TART license number must be clearly displayed on all creations using MyTagArt artist images.
3. The correct MyTagArt artist's © must be clearly displayed on all creations using their images. This must be clear and legible. Please make sure you are spelling all names correctly. You may use your own watermark, or reference to yourself as in (tagged by, sig by, tag by) type logo markings, however you may not claim a © "your name", nor may you place your website URL on any tags/sigs made. Website Banners will need to be linked as we do not allow the URL to be placed on those either. Artist URL is required on all creations.
4. MyTagArt Licensed images may not exceed 72 dpi or measure more than 500 pixels on the longest side.
5. No mixing of artist's is allowed. If using a MyTagArt artist image in a creation you cannot use another artist's work. You can however use credit free stock photography (You may add "Photo By___" or Photo Courtesy of___", but credit free meaning no © symbol), your own made elements and other non-royalty elements. You may also credit non MyTagArt Scrapkits with "Scrapkit Courtesy of ____". You MAY use MyTagArt Artists with MyTagArt Photographers and include both © but this only applies to Artists & Photographers licensed with MyTagArt.
Your copyright would look something like this:

6. Absolutely no MyTagArt images are to be used in any endeavors that would be considered by any employee or artist of MyTagArt as profiting in any way. We do allow you to print out your creations but it must be for NON Profit and personal use only.
7. The integrity of all MyTagArt artist images must remain intact at all times in creations made. Close up profiles (portrait poses, waist/chest up) of images are acceptable. No heads may be cropped off or replaced at any time.
7A. No animated body parts, or excessive animation is allowed to be used on MyTagArt artist images. Blinking and light noise used in hair and clothing is acceptable. Unless otherwise stated on the artist page.
7B. Incredimail stationary, desk top themes (wall papers), calendars are allowed. However you must display the artist © and license number on the actual creation using the image(s) and a credit with the same information on the stationary, desk top theme or calendars themselves.
7C. Greyscaling of images, mirroring or transposing is allowed, as well as monotone colour changes. However, any other colour changes is unacceptable. You cannot pick and choose where to add or change the colours. Any changes must be a single hue/tone. Multiple, single tone colour changes are permitted as long as there is one, unaltered, main tube/image on the tag as well.
8. MyTagArt artist images may NOT be used in any creations on groups or sites that support or suggesting any support in any form of racial, religious, lifestyle or age discrimination/hate/prejudice. MyTagArt artist images may also not be used in any groups/sites that promote or encourage the defamation, slander, harassment or libel against ANY person, organization, business, race or culture. MyTagArt supports the Anti-Hate philosophy and respects all lifestyles and cultures.
9. Blank tags, stationary headers, desk top themes, ect is strictly prohibited. All creations must have either a saying (for example a "Happy Birthday") or a personalized name on them. If creating a stationary side border, text is not required. However you must display the artist © and license number on the actual graphic using the image(s) and a credit with the same information on the stationary footer. Unless otherwise stated on the artist page.
10. You may write tutorials using MyTagArt artists images/tubes/photos that you hold a license for. However, you must state on the tutorial page that the artist is licensed through MyTagArt and you must supply a link to MyTagArt as well as the artist.
11. MyTagArt artists/photographers may offer FTU downloads. If you are downloading them from this site you will need to follow all our TOU and you may apply "TART FREE" to you creation instead of your License #.
Photography
1. You may use/add masks, brushes, natural element -like effects such as rain, water rippling, fog, lightening and sunshine.
1A. When using masks, framing and brushes, the integrity of the image must remain. If you use any of the above effects on a photography image, the image must be recognizable.
1B. Close up's of specific elements of the main image are allowed. You may also use other non-distortion or manipulation effects such as texturing, light scanlines and blinding. You are not permitted to use effects that would grossly distort the image (such as smearing, mosaics, pixelating, juggling, melting,ect.) unless the main image is present in the creation.
1C. Minor colour changes are permitted such as a red bloom being changed to black and white,ect.
2. You may not add any effects that are or could be reasonably perceived as obscene, defamatory or lewd.
3. You may use MyTagArt Photography with other MyTagArt Artist Images. You must give proper © information for both example:

Scrapbooking
1. You may use these with other artist work in your creations.
2. Any use must be for non-profit except for items in the Commercial Use catagory.
3. If you are using in tags, web sets, with other license company artwork and/or other graphics you must credit the creator/artist of the Scrap kits as:
Scraps by "Creator Name".
If you are using MyTagArt (TART) Scraps with MyTagArt (TART) licensed artwork, free to use art or without any artwork at all then your license number will be required. You will always need to give credit to the Scrap Designer.

5. You may use this kit to create Email Stationary, Extra's, Tags for yourself and friends
as long they are flattened.
6. You may use this kit to create your OWN blinkie.( You may NOT share this kit to a blinkie maker to have them create a blinkie for you) **Credit Must be given on your blog/website.
Commercial Use TOU
These TOU apply ONLY to products you purchase from MyTagArt which are expressly sold as Commercial Use Products.
-You MAY Use the CU items in your FTU or PTU scrapkits as long as you give proper credit in your TOU or Credit file.
-You MAY Modify the CU items to fit your need. Modification is unlimited.
-You MAY Use in combination with other artists work.
-You May NOT use MyTagArt CU Items to create large runs of products.
-You May NOT use CU Items alone. Example would be a non altered piece mass printed for sale.
-At no time may any CU products from MyTagArt be shared. This includes but is not limited to file sharing sites,blogs and groups. Sharing of CU Products is forbidden as well as any MyTagArt Product.
-You May NOT claim as your own. Credit is required in your text file and should read "MyTagArt CU Item by (Insert Artists Name)" also please add a text link to MyTagArt as well as a link to the CU Artist.
-CU Items MUST be changed from their original form before being added to any kits. You May NOT resell CU Items individually. They must be part of a kit.
-You May NOT share or sell these items on CD.
-You May NOT use in connection with High Income Projects. We do allow usage for Small Income Projects.
